enXco, the American subsidiary of EDF Energies Nouvelles, announces its intention to contest the notification of cancellation of the contract relating to the Merricourt turnkey wind project received on April 1 from Northern States Power Co., a subsidiary of the group American Xcel Energy.
Northern States Power's (NSP) decision is based on concerns recently expressed by environmental protection authorities about the project's impact on the migratory habits of avian species.
enXco is actively continuing to analyze this issue and considers that it has provided NSP with the necessary answers. For these reasons, and on the basis of the contract established between the parties, enXco contests the relevance and materiality of the reasons for cancellation invoked by NSP.
On November 3, 2008, enXco announced the development and construction of two projects for Xcel Energy: the Nobles Wind Project (201 MW) in southwest Minnesota and the Merricourt Wind Project (150 MW) in North Dakota. . These two projects were validated on May 28, 2009 by the Minnesota Public Utilities Commission. On August 12, 2009, the North Dakota Public Service Commission validated the compliance and public utility of the Merricourt project. The Nobles wind project, successfully developed and built, entered service on December 28, 2010.
